I presenti termini disciplinano l’uso professionale della piattaforma Gustify da parte di ristoratori e attività food, inclusa la sottoscrizione dell’abbonamento.

1. Oggetto del servizio
Il servizio consiste nella fornitura di un gestionale online per la creazione, gestione e visualizzazione di menu digitali, riservato a ristoratori e attività del settore food.
2. Registrazione e accesso
L'utente deve registrarsi fornendo dati corretti e aggiornati. È responsabile delle credenziali di accesso e dell'uso della piattaforma. L'account è personale e non trasferibile.
3. Utilizzo del servizio
Il servizio è destinato esclusivamente all'uso professionale. È vietato:
- L'uso improprio, la rivendita o la copia dei contenuti senza autorizzazione
- Caricare contenuti illegali, diffamatori, osceni o che violino diritti di terzi
- Utilizzare la piattaforma per scopi fraudolenti o dannosi
- Tentare di accedere a sistemi o dati non autorizzati
4. Dati inseriti dagli utenti e ruolo del titolare del trattamento
I dati relativi a piatti, prenotazioni, clienti finali e preferenze alimentari restano trattati dal ristoratore quale titolare ai sensi del GDPR. Il gestore della piattaforma Gustify agisce come responsabile del trattamento per le operazioni tecniche necessarie all'erogazione del servizio. Per attività di analisi aggregate/pseudonimizzate di piattaforma (incluse statistiche cross-ristorante per finalità di sicurezza, miglioramento prodotto e marketing professionale B2B), Gustify può operare come titolare autonomo nei limiti indicati nella Privacy Policy. Il ristoratore è tenuto a:
- Informare adeguatamente i propri clienti finali sul trattamento dei loro dati personali
- Ottenere i consensi necessari ove richiesto dalla legge
- Garantire la liceità e correttezza dei dati inseriti
- Rispondere alle richieste dei propri clienti relative ai loro diritti privacy
5. Limitazione di responsabilità
Il gestore del gestionale non garantisce l'assenza di interruzioni o errori, né l'integrità totale dei dati. In nessun caso il gestore sarà responsabile per:
- Danni indiretti o perdita di profitti derivanti dall'uso del servizio
- Perdita di dati causata da errori dell'utente o eventi di forza maggiore
- Contenuti inseriti dagli utenti che violino diritti di terzi
- Uso improprio della piattaforma da parte dell'utente o di terzi
L'utente si impegna a manlevare il gestore da qualsiasi richiesta o danno derivante da un uso illecito o non conforme ai presenti termini.
6. Proprietà intellettuale
La piattaforma Gustify, il suo codice, design e marchi sono di proprietà esclusiva del gestore. I contenuti inseriti dall'utente (testi, immagini, menu) rimangono di sua proprietà, ma l'utente concede al gestore una licenza d'uso limitata alle finalità del servizio.
7. Durata, pagamenti e disdetta
L'abbonamento ha durata mensile o annuale secondo il piano scelto. Il pagamento avviene tramite Stripe secondo le condizioni visualizzate in fase di sottoscrizione. Prima del pagamento l'utente deve accettare esplicitamente Termini e Condizioni e Privacy Policy tramite meccanismo clickwrap (checkbox). Il gestore conserva la prova di accettazione (timestamp, versione documenti e identificativi tecnici essenziali) per finalità di compliance contrattuale e difesa in giudizio. L'utente può disdire in ogni momento l'abbonamento dalle impostazioni del proprio account. La disdetta ha effetto dalla fine del periodo già pagato. Il gestore può sospendere o interrompere il servizio in caso di:
- Mancato pagamento
- Uso illecito o violazione dei presenti termini
- Comportamenti che danneggino la piattaforma o altri utenti
8. Statistiche e cookie tecnici
Per garantire il corretto funzionamento del servizio il gestionale impiega cookie first-party necessari (es. gustify_vid e gustify_cookie_consent). La piattaforma può produrre statistiche aggregate e reportistica professionale (anche cross-ristorante) per finalità di sicurezza, miglioramento del servizio e marketing B2B, con dati pseudonimizzati/aggregati. Le funzioni analytics avanzate lato utente finale sono abilitate nel rispetto delle preferenze di consenso applicabili.
9. Modifiche ai termini
Il gestore si riserva il diritto di modificare i presenti termini in qualsiasi momento. Le modifiche sostanziali verranno comunicate agli utenti con almeno 30 giorni di preavviso via email o tramite notifica sulla piattaforma. L'uso continuato del servizio dopo l'entrata in vigore delle modifiche costituisce accettazione delle stesse.
10. Legge applicabile e foro competente
I presenti termini sono regolati dalla legge italiana. Per qualsiasi controversia è competente esclusivamente il Foro di Napoli.

These terms govern professional use of the Gustify platform by restaurateurs and food businesses, including subscription checkout.

1. Service scope
The service consists of providing an online management system for the creation, management, and display of digital menus, reserved for restaurateurs and food businesses.
2. Registration and access
The user must register by providing correct and updated data. They are responsible for access credentials and use of the platform. The account is personal and non-transferable.
3. Use of the service
The service is intended exclusively for professional use. It is prohibited to:
- Misuse, resell, or copy content without authorization
- Upload illegal, defamatory, obscene content or content that violates third-party rights
- Use the platform for fraudulent or harmful purposes
- Attempt to access unauthorized systems or data
4. User data and data controller role
Data relating to dishes, reservations, end customers, and food preferences remains under the restaurateur's control as data controller under GDPR. The Gustify platform manager acts as a data processor for the technical operations needed to deliver the service. For aggregated/pseudonymized platform analytics (including cross-restaurant statistics for security, product improvement, and B2B professional marketing reporting), Gustify may act as an independent controller within the limits described in the Privacy Policy. The restaurateur is required to:
- Adequately inform their end customers about the processing of their personal data
- Obtain necessary consents where required by law
- Ensure the lawfulness and correctness of the entered data
- Respond to their customers' requests regarding their privacy rights
5. Limitation of liability
The management system operator does not guarantee the absence of interruptions or errors, nor the total integrity of the data. Under no circumstances will the operator be liable for:
- Indirect damages or loss of profits resulting from the use of the service
- Data loss caused by user errors or force majeure events
- Content entered by users that violates third-party rights
- Improper use of the platform by the user or third parties
The user agrees to hold harmless the operator from any claim or damage arising from unlawful use or use not in compliance with these terms.
6. Intellectual property
The Gustify platform, its code, design, and trademarks are the exclusive property of the operator. Content entered by the user (texts, images, menus) remains their property, but the user grants the operator a limited use license for service purposes.
7. Duration, payments and termination
The subscription has a monthly or annual duration according to the chosen plan. Payment is made via Stripe according to the conditions displayed during subscription. Before payment, the user must explicitly accept the Terms and Conditions and Privacy Policy via clickwrap checkbox. The operator stores proof of acceptance (timestamp, policy versions, and essential technical identifiers) for contractual compliance and legal defense. The user may cancel the subscription at any time from account settings. Cancellation takes effect at the end of the paid period. The operator may suspend or terminate the service in case of:
- Non-payment
- Unlawful use or violation of these terms
- Behavior that damages the platform or other users
8. Statistics and technical cookies
To ensure proper service operation, the platform uses necessary first-party cookies (e.g. gustify_vid and gustify_cookie_consent). The platform may produce aggregated professional reporting (including cross-restaurant reporting) for security, service improvement, and B2B marketing purposes using pseudonymized/aggregated data. Advanced end-user analytics features are enabled according to applicable consent preferences.
9. Changes to the terms
The operator reserves the right to modify these terms at any time. Substantial changes will be communicated to users with at least 30 days' notice via email or platform notification. Continued use of the service after the changes take effect constitutes acceptance of them.
10. Applicable law and jurisdiction
These terms are governed by Italian law. For any dispute, the Court of Naples has exclusive jurisdiction.

Diese Bedingungen regeln die professionelle Nutzung der Gustify-Plattform durch Gastronomen und Food-Betriebe, einschließlich des Abonnement-Abschlusses.

1. Leistungsgegenstand
Der Service besteht in der Bereitstellung eines Online-Managementsystems zur Erstellung, Verwaltung und Anzeige digitaler Speisekarten, vorbehalten für Gastronomen und Unternehmen der Lebensmittelbranche.
2. Registrierung und Zugang
Der Nutzer muss sich registrieren und korrekte sowie aktuelle Daten angeben. Er ist für die Zugangsdaten und die Nutzung der Plattform verantwortlich. Der Account ist persönlich und nicht übertragbar.
3. Nutzung des Dienstes
Der Dienst ist ausschließlich für den professionellen Gebrauch bestimmt. Es ist verboten:
- Missbrauch, Weiterverkauf oder Kopieren von Inhalten ohne Genehmigung
- Hochladen illegaler, diffamierender, obszöner Inhalte oder Inhalte, die Rechte Dritter verletzen
- Nutzung der Plattform für betrügerische oder schädliche Zwecke
- Versuch des Zugriffs auf nicht autorisierte Systeme oder Daten
4. Nutzerdaten und Rolle des Verantwortlichen
Die Daten zu Gerichten, Reservierungen, Endkunden und Ernährungsvorlieben bleiben unter der Verantwortung des Gastronomen als Verantwortlicher gemäß DSGVO. Der Betreiber der Gustify-Plattform handelt für die technischen Vorgänge zur Leistungserbringung als Auftragsverarbeiter. Für aggregierte/pseudonymisierte Plattformanalysen (einschließlich standortübergreifender Statistiken für Sicherheit, Produktverbesserung und professionelles B2B-Marketing-Reporting) kann Gustify als eigenständiger Verantwortlicher in dem in der Privacy Policy beschriebenen Umfang handeln. Der Gastronom ist verpflichtet:
- Seine Endkunden angemessen über die Verarbeitung ihrer personenbezogenen Daten zu informieren
- Erforderliche Einwilligungen einzuholen, wo gesetzlich vorgeschrieben
- Die Rechtmäßigkeit und Korrektheit der eingegebenen Daten zu gewährleisten
- Auf Anfragen seiner Kunden bezüglich ihrer Datenschutzrechte zu antworten
5. Haftungsbeschränkung
Der Betreiber des Managementsystems garantiert nicht die Abwesenheit von Unterbrechungen oder Fehlern, noch die vollständige Integrität der Daten. In keinem Fall haftet der Betreiber für:
- Indirekte Schäden oder Gewinnverluste, die sich aus der Nutzung des Dienstes ergeben
- Datenverlust durch Nutzerfehler oder höhere Gewalt
- Vom Nutzer eingegebene Inhalte, die Rechte Dritter verletzen
- Unsachgemäße Nutzung der Plattform durch den Nutzer oder Dritte
Der Nutzer verpflichtet sich, den Betreiber von jeglichen Ansprüchen oder Schäden freizustellen, die aus rechtswidriger oder nicht diesen Bedingungen entsprechender Nutzung entstehen.
6. Geistiges Eigentum
Die Gustify-Plattform, ihr Code, Design und ihre Marken sind ausschließliches Eigentum des Betreibers. Vom Nutzer eingegebene Inhalte (Texte, Bilder, Menüs) bleiben sein Eigentum, aber der Nutzer gewährt dem Betreiber eine begrenzte Nutzungslizenz für Servicezwecke.
7. Laufzeit, Zahlungen und Kündigung
Das Abonnement hat gemäß dem gewählten Plan eine monatliche oder jährliche Laufzeit. Die Zahlung erfolgt über Stripe gemäß den bei der Abonnierung angezeigten Bedingungen. Vor dem Zahlungsvorgang muss der Nutzer die AGB und die Privacy Policy ausdrücklich per Clickwrap-Checkbox akzeptieren. Der Betreiber speichert einen Akzeptanznachweis (Zeitstempel, Dokumentversionen und wesentliche technische Kennungen) für Vertrags-Compliance und Rechtsverteidigung. Der Nutzer kann das Abonnement jederzeit über seine Kontoeinstellungen kündigen. Die Kündigung wird zum Ende des bereits bezahlten Zeitraums wirksam. Der Betreiber kann den Dienst aussetzen oder beenden bei:
- Nichtzahlung
- Rechtswidriger Nutzung oder Verstoß gegen diese Bedingungen
- Verhalten, das die Plattform oder andere Nutzer schädigt
8. Statistiken und technische Cookies
Zur Gewährleistung des ordnungsgemäßen Betriebs verwendet die Plattform notwendige First-Party-Cookies (z. B. gustify_vid und gustify_cookie_consent). Die Plattform kann aggregierte professionelle Reportings (einschließlich standortübergreifender Auswertungen) für Sicherheit, Serviceverbesserung und B2B-Marketing erstellen; dabei werden pseudonymisierte/aggregierte Daten verwendet. Erweiterte Endnutzer-Analytics werden gemäß den jeweils geltenden Einwilligungseinstellungen aktiviert.
9. Änderungen der Bedingungen
Der Betreiber behält sich das Recht vor, diese Bedingungen jederzeit zu ändern. Wesentliche Änderungen werden den Nutzern mit mindestens 30 Tagen Vorlauf per E-Mail oder Plattform-Benachrichtigung mitgeteilt. Die fortgesetzte Nutzung des Dienstes nach Inkrafttreten der Änderungen stellt deren Annahme dar.
10. Anwendbares Recht und Gerichtsstand
Diese Bedingungen unterliegen italienischem Recht. Für jegliche Streitigkeiten ist ausschließlich das Gericht von Neapel zuständig.
